These Terms govern your use of the Dart Rise website and the apps we publish (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

Using the Service

We grant you a personal, limited, non-exclusive, non-transferable right to use the Service for your own lawful purposes. In return, you agree not to:

  • Use the Service in any way that breaks the law or infringes someone else’s rights.
  • Copy, modify, reverse engineer, or attempt to extract the source code of our apps, except where the law expressly allows it.
  • Interfere with, disrupt, or place an unreasonable load on the Service or the systems behind it.
  • Access the Service through automated means in a way that harms it or other users.

Purchases and subscriptions

Some apps may offer paid features, one-time purchases, or subscriptions. These are processed by the app store you bought them from, under that store’s payment terms. Pricing, billing, renewals, and refunds are handled by the store, so please review its policies for anything related to your transaction.

Intellectual property

The Service, including its software, design, text, graphics, logos, and the Dart Rise name, is owned by the Studio or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you beyond the limited right to use the Service described above.

Third-party links and services

The Service may link to or rely on websites and services we do not control, such as app stores and analytics providers. We are not responsible for their content, policies, or practices, and your use of them is governed by their own terms.

Termination

We may suspend or end your access to the Service at any time if you breach these Terms or if we need to protect the Service or its users. You can stop using the Service at any time. Provisions that by their nature should survive termination - such as intellectual property, disclaimers, and limitation of liability - will continue to apply.

Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that it will meet your particular requirements.

Limitation of liability

To the fullest extent permitted by law, Dart Rise will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising out of your use of the Service. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Governing law

These Terms are governed by the laws applicable at the Studio’s principal place of business, without regard to conflict-of-law rules. Your local consumer protection laws may also grant you rights that these Terms cannot override.

Disputes

If you have a concern, please contact us first - most issues can be resolved quickly and informally. If a dispute cannot be settled that way, it will be handled under the governing law described above.

For European Union (EU) users

If you are a consumer living in the European Union, you keep the benefit of any mandatory protections granted by the law of the country where you reside. Nothing in these Terms limits those rights.

United States legal compliance

You confirm that you are not located in a country subject to a United States government embargo, or one that the U.S. government has designated as supporting terrorism, and that you are not listed on any U.S. government register of prohibited or restricted parties.

Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “last updated” date at the top of this page. Continuing to use the Service after changes take effect means you accept the updated Terms.

Severability

If any part of these Terms is found to be unenforceable, the rest will remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later.

Translation

If we provide these Terms in more than one language, the translation is offered for your convenience. If there is any conflict between versions, the original English text is the one that applies.
